1. Acceptance of Terms

Welcome to SnapMagic ("we," "our," or "us"). By downloading, accessing, or using our mobile application and services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

2. Service Description

2.1 What SnapMagic Does

SnapMagic is an AI-powered mobile application that provides:

• Photo Restoration: Repair damaged, scratched, or faded photographs
• Photo Colorization: Add realistic colors to black and white photographs
• Photo Animation: Create short animated videos from still photographs
• Image Enhancement: Improve quality, sharpness, and resolution of photographs

SnapMagic operates on a credit-based system where different operations consume credits:

3. Subscription Plans

3.1 Available Plans

• Pro Monthly: 100 credits per month, automatically renewed
• Elite Monthly: 300 credits per month, automatically renewed
• Credit Bundles: One-time purchases of 100 or 500 credits

3.2 Billing and Renewal

• Subscriptions are billed monthly through your Apple App Store or Google Play account
• Subscriptions automatically renew unless cancelled at least 24 hours before the current period ends
• You will be charged for renewal within 24 hours prior to the end of the current period
• Credits from monthly subscriptions are added to your account at the beginning of each billing cycle
• Unused credits from subscriptions do not roll over to the next billing period
• Credits from one-time bundles do not expire

3.3 Cancellation and Refunds

• You can cancel your subscription at any time through your App Store or Google Play account settings
• Cancellation takes effect at the end of your current billing period
• No refunds are provided for partial billing periods
• Any remaining credits in your account will be retained after cancellation
• Refunds are subject to Apple App Store and Google Play Store policies

4. User Content and Responsibilities

4.1 Your Content Rights

• You retain all rights to the photographs you upload to SnapMagic
• You grant us a limited license to process your photos solely to provide our services
• We do not claim ownership of your original photographs or processed results
• You are responsible for having all necessary rights to upload and process content

4.2 Content Restrictions

You agree not to upload content that:

• Violates any law or regulation
• Infringes on intellectual property rights of others
• Contains harmful, offensive, or inappropriate material
• Includes personally identifiable information of minors without consent
• Contains malware, viruses, or other harmful code

4.3 Account Responsibilities

• You are responsible for maintaining the security of your account
• You must provide accurate and complete information
• You are responsible for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

5. Data Processing and Privacy

5.1 Photo Processing

• Uploaded photos are processed using artificial intelligence technology
• Photos are temporarily stored on secure servers during processing
• Original photos are automatically deleted from our servers within 48 hours
• Processed results are available for download for 30 days, then deleted

5.2 Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

6. Service Limitations and Disclaimers

6.1 Processing Limitations

• Processing times may vary from seconds to several minutes depending on complexity
• Results depend on the quality and condition of input photographs
• Some photographs may not process successfully due to technical limitations
• We do not guarantee specific quality or appearance of processed results

6.2 Service Availability

• We strive to maintain high service availability but do not guarantee 100% uptime
• Services may be temporarily unavailable due to maintenance, updates, or technical issues
• We reserve the right to modify, suspend, or discontinue features with notice

6.3 Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SNAPMAGIC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, PROFITS, OR USE, ARISING FROM YOUR USE OF THE SERVICE.

8. Intellectual Property

8.1 Our IP Rights

• SnapMagic owns all rights to the application, algorithms, and technology
• Our trademarks, logos, and brand elements are protected intellectual property
• You may not copy, modify, distribute, or reverse engineer our technology

8.2 User License

• We grant you a limited, non-exclusive license to use the Service for personal purposes
• You may not use the Service for commercial purposes without permission
• This license terminates when your account is closed or these Terms end

9. Account Termination

9.1 Termination by You

• You may delete your account at any time through the app settings
• Account deletion is permanent and cannot be undone
• Remaining credits will be forfeited upon account deletion

9.2 Termination by Us

We may suspend or terminate accounts that:

• Violate these Terms of Service
• Engage in fraudulent or abusive behavior
• Upload prohibited content repeatedly
• Attempt to compromise service security

10. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated through the app or email. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

11. Governing Law and Disputes

• These Terms are governed by the laws of [Your Jurisdiction]
• Disputes will be resolved through binding arbitration where permitted by law
• You agree to resolve disputes individually, not as part of a class action
